Section 1983 Actions in the New York Courts

    Abstract

    During the past decade there has been a sharp increase in the volume of § 1983 litigation in the New York state courts. The precise number of § 1983 cases filed in the New York courts is uncertain because state court statistics do not break civil filings down this way, but a review of reported appellate court decisions makes clear that an increasing number of § 1983 plaintiffs are forsaking federal courts and seeking relief in the New York courts.
